The Seller: For purpose of this sale, the "Seller" is the party offering the item for sell and may or may not be named on the item's title as the item's owner, if any is applicable for this item.
Placing A Deposit For The Item's Purchase: The winning bidder (the Buyer), or second chance Buyer MUST -- WITHIN TWENTY-FOUR (24) HOURS OF THE AUCTION'S END: 1.) Make the required $500.00 deposit to the Seller via the item's Paypal link located within the item's listing, and 2.) Through e-bay's e-mail "MESSAGES", leave the Seller the Buyer's full name, address, and phone number.
NOTE: Time is of the essence. If the Buyer does not pay the full deposit to Paypal within 24 hours of the auction's end; or the Buyer's Paypal deposit does not clear, both, the Seller's Paypal and bank account within one (1) week from the auction's end; or the Buyer does not e-mail the Seller through e-bay's e-mail "Messages", giving the Seller the Buyer's contact information as stipulated; then the Seller may nullify and void this transaction and neither the Seller nor the Buyer shall have any further obligation to the other; whereupon, the Buyer's deposit, if any, shall be forfeited to the Seller.
Full Payment of Balance Due: The "Full Payment of Balance Due" is due and must be paid within _3_ days of the auction's end; or, within the time frame stipulated within the item's listing, whichever is greater; to be paid in person in cash, or online through Paypal. If the Buyer desires to use Paypal to pay the "Full Payment of Balance Due": 1.) Such payment must be made by going directly to Paypal's web site (not through e-bay, as the item's Paypal link on e-bay will not accept any additional funds once the Buyer has satisfied the required Paypal deposit amount), and depositing such "Full Payment of Balance Due" to the Seller's Paypal e-mail account address that the Seller will provide the Buyer once the initial required deposit clears, both, Paypal and the Seller's bank; and 2.) Such "Full Payment of Balance Due" paid using Paypal must clear, both, Paypal and the Seller's bank within one (1) week of the auction's end. (Paypal's site states that such deposits clear their account in 3 -5 days.)
NOTE: Time is of the essence. If the Buyer's "Full Payment of Balance Due" is not paid within the above timeframe specified in cash or via Paypal; or, in the case whereby the Buyer uses Paypal to pay such "Full Payment of Balance Due"; such Paypal payment does not clear, both, Paypal and the Seller's bank account within one (1) week of the auction's end; then the Seller may nullify and void this transaction and neither the Seller nor the Buyer shall have any further obligation to the other, whereupon the Buyer's deposit shall be forfeited to the Seller.
Delivery: Provided the Buyer's Paypal deposit clears, both, the Seller's Paypal and bank account as specified (see "Placing A Deposit For The Item's Purchase"), the item's keys and title shall be given to the Buyer, whereby the Buyer hereby agrees to take immediate delivery of the item, upon: 1.) The Buyer fully paying the "Full Payment of Balance Due" to the Seller, in person, in cash; or, in the case whereby the Buyer uses Paypal to pay such "Full Payment of Balance Due", upon the Seller notifying the Buyer that the Buyer's "Full Payment of Balance Due" made through Paypal has cleared, both, Paypal and the Seller's bank, and 2.) Upon the Buyer signing a copy of this "TERMS AND CONDITIONS OF SALE" and "Warranty Information".
Storage Fee: In addition to all other amounts the Buyer may owe the Seller, the Buyer shall incur and pay the Seller a $50.00 per day charge at the time of delivery for any and all days the vehicle remains with the Seller after the "Full Payment of Balance Due" date specified above (i.e., after the third (3rd) day of the auction's end and thereafter), regardless if the Buyer satisfies, either, the required deposit or the "Full Payment of Balance Due", and regardless if the Buyer takes delivery and returns the vehicle for any reason. Alternatively, the Buyer agrees that the Seller, without notice, may tow and impound the item at the Buyer's expense.
Odometer Readings: Due to demo test drives and mechanical inspections, the mileage stated within the item's listing may be different than the item's actual mileage at the time of delivery; and, such mileage may or may not be the vehicles actual mileage.
Bidding: Prospective Buyer's making bids constitutes a legally binding contract to purchase this item. Please do not bid if you're not seriously interested or financially able to purchase this item. Please read e-Bay's "User Agreement". All non-paying high bidders will be reported to e-bay, and negative feedback posted.
Bidder's Age: You must be 18 years of age or older to bid.
Bid Retraction: Please read e-Bay's "Retracting a Bid". If you place a bid before the last 12-hour period of the auction, you may retract the bid before the last 12-hour period only for exceptional circumstances. You will not be allowed to retract that bid during the last 12-hour period of the auction. If you place a bid during the last 12-hour period of the auction, you will be allowed to retract the bid for exceptional circumstances only if you do so within one hour after placing the bid. All bids are legally binding and are absolute. A Buyer cannot, under no circumstance, make a contingency bid — you cannot stipulate any condition that cancels, deletes, or voids your bid for any reason.
Buyer's Inspection: We welcome prospective Buyer's to look at and inspect the item. Prospective Buyer's may look at and inspect the item prior to making a bid or agreeing to pay any price for the item, no less than 48 hours prior to the end of the auction. To be fair to those whom may have already bid on the item, only the actual Buyer shall receive the keys and title to the item and shall only receive such upon fully satisfying the "Full Payment of Balance Due" terms. The prospective Buyer is responsible for any inspection fees.
Seller's Right To Cancel Bids: The Seller reserves the right to, without notice nor reason, end or cancel this auction for this item at anytime (i.e., before, during, or after the auction.); to cancel any one or all bids for the item, or cancel any sale for the item, or cancel any transaction for the item. In particular, this applies to, but is not limited to: Prospective Buyer who breach any of the Terms and Conditions listed herein, Buyers attempting to buy outside of e-bay, Buyers that the Seller believes may be violating e-bay's policies, or Buyers that the Seller believes may cause the Seller to violate e-bay's policies.
Also, the Buyer understands and, hereby, agrees that the Seller reserves the right to end or cancel any Second Chance Offer of the item that the Seller may offer the Buyer, at anytime -- including after such time that the prospective Buyer pays the required Paypal deposit. If this should happen, the Seller shall return such deposit promptly.
